What is a CDL DUI?

Several rules in the California Vehicle Code make it a crime for individuals to drive while under the influence of drugs and or alcohol. For instance, California Vehicle Code 2315(a-b) stipulates that it is a crime to drive a vehicle under the influence of alcohol and or drugs, specifically with a blood alcohol content of 0.08% or higher. California Vehicle Code 23152(d) makes it a crime for those with a CDL who are found driving a commercial vehicle with a blood alcohol content of 0.04% or higher.

When someone is accused of a DUI while operating a commercial vehicle, they can receive up to six months in jail, a fine between $390 and $1,000, three to five years of probation, and three or nine months of mandatory education programs. Defendants may also be forced to install an ignition interlock device on their car and would lose their CDL license for up to a year.
